State Senator In Court Over DUI

Kentucky State Senator Brandon Smith was in court today where he pleaded not guilty to a DUI charge and surrendered his drivers license.

Smith was arrested on January 6, the first day of the 2015 legislative session. Smith — who represents the 30th District, was charged with DUI in Frankfort just miles away from the capitol building itself.

Last month, Smith’s lawyer filed a motion to dismiss the charge based on an 1891 state law that prohibits lawmakers from being arrested for certain offenses while the legislature is in session. He later dropped that motion after the story got national attention.

Smith represents the 30th District, which includes several counties in Eastern Kentucky.

A Trial date has not been set.
